Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you (“You”) and SellBotAI, LLC ("Company", “we”, “us”, or “our”). By clicking "I Agree," registering for an account, or accessing the Service, you agree that you have read, understood, and agree to be bound by all of these Terms of Use.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND MUST DISCONTINUE USE IMMEDIATELY.

Nature of the Service

WARNING: AI LIMITATIONS. SellBotAI utilizes artificial intelligence (including OpenAI and computer vision technologies) to assist sellers in generating listing drafts. You acknowledge and agree that:

  • AI is Fallible: The Service may generate content, including descriptions, item specifics, pricing suggestions, and brand identifications, that is factually incorrect, offensive, or hallucinated.
  • Human Verification Required: You are solely responsible for reviewing, verifying, and editing all data generated by the Service before submitting it to eBay or any other marketplace.
  • No Automation of Judgment: The Service is a productivity tool, not a substitute for human judgment. Reliance on any information provided by the Service is solely at your own risk.

eBay Independence & Compliance

SellBotAI is a third-party tool and is not affiliated with, endorsed by, or sponsored by eBay Inc.

  • User Responsibility: You agree to abide by all eBay User Agreements and Policies. It is your responsibility to ensure that any listing generated by our Service complies with eBay’s prohibited item policies and VeRO (Verified Rights Owner) guidelines.
  • Account Status: We are not responsible for any actions taken by eBay against your account, including listings removal, search demotion, or account suspension/banning, resulting from your use of SellBotAI.
  • Account Security: You are responsible for maintaining the security of your device and your eBay login session. You agree to notify us immediately of any unauthorized use of your account.

Intellectual Property Rights

A. Your Content (Input)
You retain full ownership of the photos and data you upload to the Service ("User Contributions"). However, by uploading photos, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Host, copy, and process the images for the purpose of generating your listings.
  • Transmit strictly necessary data to third-party AI processors (e.g., OpenAI) for analysis.
  • Use anonymized data for the improvement of our AI models.

B. Our Output
Subject to your compliance with these Terms, we assign to you the right to use the text and data generated by the Service for your commercial e-commerce listings.

Prohibited Activities

In addition to standard illegal activities, you strictly agree NOT to use SellBotAI to:

  • Generate listings for illegal goods, weapons, drugs, counterfeit items, or any items prohibited by eBay’s policies.
  • Upload images of nudity, violence, or offensive material for AI processing.
  • Reverse engineer, decompile, or attempt to derive the source code or prompts used by our AI models.
  • Use the Service to circumvent eBay’s selling limits or fees.

Third-Party Services & Uptime

The Service relies on third-party APIs (including eBay, OpenAI, and Stripe).

  • No Guarantee: We do not guarantee 100% uptime. Services may be interrupted by API outages from our providers which are beyond our control.
  • Liability: We are not liable for any downtime, data loss, or failed listings caused by third-party API failures.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT: (A) THE AI-GENERATED DESCRIPTIONS OR PRICING WILL BE ACCURATE OR ERROR-FREE. (B) THE SERVICE WILL PREVENT EBAY ACCOUNT SUSPENSIONS. (C) THE SERVICE WILL IDENTIFY COUNTERFEIT ITEMS ACCURATELY.

Limitations of Liability

IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR LOSS OF EBAY ACCOUNT STATUS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand made by any third party (including eBay Inc. or Intellectual Property rights holders) due to or arising out of: (1) your Listings; (2) your use of the Service; (3) your violation of these Terms; or (4) your violation of the rights of a third party, including but not limited to selling counterfeit goods or infringing on trademarks.

Dispute Resolution

Any dispute arising from these Terms shall be resolved through binding arbitration. You agree to waive your right to a jury trial and your right to participate in a class-action lawsuit. The arbitration shall be conducted in Jackson County, Oregon.

Term and Termination

Cancellation by You: You may cancel your subscription at any time via your account settings. Your access will continue until the end of the current billing cycle.

Termination by Us: We reserve the right to suspend or terminate your account immediately, without notice or refund, if you violate these Terms, engage in illegal activity, or abuse the Service/Support staff.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via the email associated with your account or through a dashboard notification. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
